Mr Mensah wanted to contest as an Assemblyman for the Eyipeh Electoral Area within the Effutu District.
In an earlier interview with Citi News, Afenyo-Markin said all attempts to get the EC to include his client in the process proved futile, hence the decision to go to court.
He accused the Commission of breaching the constitution with their refusal to adhere to the rules governing the conduct of the elections.
But the EC has insisted it followed due process.
Mr. Mensah thus wants the court to “order the Electoral Commission to re-open nominations to enable the Plaintiff and other law abiding citizens…to file their nomination forms to participate in the upcoming District Assembly Elections.”
The Director of Communications at the EC, Christian Owusu Parry has told Citi News, the writ has been forwarded to the lawyers of the Commission for the necessary action to be taken.
“We have been served with the writ and the lawyers know the processes so they will handle the matter,” he remarked.
